These General Terms and Conditions apply to the online services offered by The Haciendas Company Ltd. on its websites www.the-haciendas.com and www.the-haciendas.com/warehouse (jointly, the “Websites”), that are offered exclusively to legal and natural persons that meet the following requirements: (i) be residents in countries where it is allowed to consume and/or sell and/or promote alcoholic beverages; (ii) be of legal age or have the minimum age to consume and purchase alcohol in your country; and (iii) be able to purchase products or services from The Haciendas Company without violating any regulations.
Please read the following Terms and Conditions carefully. By accessing the Websites, the pages they contain or other sites accessible from them, you (the “User”) declare that you understand and accept the application of these Terms and Conditions. If you do not agree with them, please refrain from accessing the Websites and the pages they contain.
Users may only use the Websites to the extent permitted by current legislation.
These Terms and Conditions may be modified at any time and without prior notice. In case of modification, the use of the Websites will be interpreted as an acceptance of the new Terms and Conditions.
To refer to these Terms and Conditions, the expression “T&C” may also be used.
2.- Who we are
The Haciendas Company and The Haciendas are trade names and/or trademarks of The Haciendas-Company Ltd. (hereinafter “THC Ltd.”) and/or The Haciendas-Company – Sucursal em Portugal (hereinafter “THC ”).
THC Ltd. is a company incorporated under the laws of England and Wales, registered in the Companies Register under number 8228267 and with its registered office at Broken Wharf House, 2 Broken Wharf, EC4V 3DT London, United Kingdom. The Haciendas-Company Ltd. is a subsidiary of the Spanish entity Corporación Financiera Arco SL, parent company of the Arco group of companies (www.cfarco.com).
THC is a branch of The Haciendas-Company Ltd. legally incorporated in Portugal, with registered office at Avenida de la República nº 15 4º piso, 1050-185 Lisboa (Portugal) and NIPC 980486173. THC is dedicated, among other things, to marketing , distribution, wholesale and retail sales and direct business-to-consumer and business-to-business sales (both online and offline) of wines and food products, as well as general hospitality services such as restaurants, hotels, celebrations and banquets .
THC manages on behalf of THC Ltd. the commercial information related to its clients or users of The Haciendas Club, whose members can enjoy exclusive offers, discounts and other advantages when they stay at our luxurious hotels, visit our restaurants or purchase our wines and gastronomic products.
Except as otherwise stated in these T&C, the products and services offered on the Websites are products and services of THC Ltd.
3.- License, access and use of the Websites
The copyright of the Websites and all their materials (including, among other things, text, computer code, illustrations, photographs, images, music, audio, video and audiovisual material included in the Websites) is owned by The Haciendas-Company Ltd. and its licensors.
Subject to compliance with these T&Cs, THC Ltd. grants Users a limited, non-exclusive, non-transferable or non-sublicensable right to access and use the Websites for personal, non-commercial purposes. This license does not include in any case the resale or commercial use of the products and services offered on the Websites or their contents; the acquisition and use of product lists, descriptions or prices; downloading or copying user account data for other vendors; nor the use of robots or similar data extraction tools.
THC Ltd. or its licensors, suppliers, publishers, assigns and other content providers reserve any rights not expressly granted in these Terms and Conditions.
The licenses granted by THC Ltd. will cease to be valid in the event of a breach of these Terms and Conditions by Users.
The Websites may only be used to obtain information about The Haciendas Company, its products and services, as well as to make reservations or permitted purchases. Use of the Websites for any other purpose, including but not limited to speculative, false or fraudulent reservations and/or purchases or reservations in anticipation of demand, is prohibited.
The User undertakes not to use any robot, spider or other automatic or manual mechanism to monitor or copy the Websites or their contents without the prior written authorization of THC Ltd. and/or THC, as well as not to interfere or try to interfere in any way with the proper working of the Websites. The User also agrees not to transfer to THC Ltd. and/or THC and/or the Websites (i) viruses, worms and/or other computer programs that seek to damage, alter, intercept or unduly control systems, data or information, and (ii) content that may cause THC and/or THC Ltd. to incur liability or that may cause damage to THC and/or THC Ltd. or its business operations.
The reproduction, duplication, sale, distribution, visit or any type of commercial exploitation of the Websites and the products and services offered on them, in whole or in part, without our prior written authorization, is prohibited.
The User undertakes to indemnify THC and/or THC Ltd. for any loss, damage or claim that may occur as a result of improper use of the Websites or any service included in them or accessible from them, as well as for any breach of these Terms and Conditions.
4.- User Accounts
Users may be required to create an account (hereinafter referred to as the “User Account”) in order to use the Websites and access the products and services of THC Ltd.
The User will be responsible for maintaining the password of his User Account to limit access to his system and, to the extent permitted by law, he agrees to assume responsibility for all activities that are carried out in his User Account or using your password. The User must take all appropriate measures to guarantee the confidentiality of his password and will inform us immediately if he has any reason to believe that someone may know his password, or if he thinks that his password is being or may be used without authorization. The User will also have the responsibility to verify that all the information provided to us is correct and complete, as well as to notify us of any change in said information.
We reserve the right to deny service, cancel User Accounts and remove or modify content in the event of non-compliance with current legislation, these T&C or other applicable conditions, guidelines or policies.
5.- Products and services offered on our Websites
- 5.1 Products and services
(I) The Haciendas Club:
THC Ltd. offers its customers the possibility of joining the club in its various categories to access special offers on wines, as well as other discounts and benefits that are specified in the terms and conditions of the club. Discounts and benefits may vary depending on the category of each member. THC Ltd. reserves the right to exchange said discounts and/or benefits for others of equivalent value. THC Ltd. will inform members of any changes with reasonable notice.
The vintage year of the offered wines may vary.
The annual subscription to The Haciendas Club consists of a single fee that is paid on the day of registration. Payment can be made by debit/credit card (Visa, MasterCard or American Express) on our Website.
The shipment of the selected wines is free for members in the United Kingdom (England, Wales and part of Scotland), Spain (peninsula) and Portugal. For other countries, the corresponding shipping costs will apply. Contact our Customer Service Department for a quote.
For wine shipments to Ceuta, Melilla, Canary Islands, Balearic Islands, Isle of Man, Isles of Scilly, Scottish Highlands and Islands or Northern Ireland, please contact our Customer Service Department to receive a quote. . Due to customs restrictions we are unable to ship to the Channel Islands (Alderny, Gurnsey, Jersey, Sark) and the Republic of Ireland.
THC Ltd. will send an email to confirm payment within two business days from the date of registration. Members will not be able to cancel their annual subscription once the legal period of 14 days has elapsed to exercise their cancellation right, as explained below.
In the club categories that offer accommodation at Hacienda Zorita or other establishments, members must pay the entire annual fee to benefit from free nights. Reservations must be made in advance and availability is not guaranteed.
Membership fees are subject to changes in indirect taxes, special taxes or VAT (VAT).
(II) Our hotels and restaurants:
The Haciendas Company offers its clients a wide variety of hotels and restaurants, regardless of whether they are members of The Haciendas Club or not.
Reservations can be made on our Website, by sending an email to the membership service at contactus@the-haciendas.com or by calling our Sales and Customer Service Department (0034) 911 441 290 in Spain and (0044) 845 60 38 565 for other countries).
(III) The Warehouse:
The Warehouse is our online store. Users can use the Websites to buy our products, which not only include wines but also a selection of quality Spanish products, such as cheese, Iberian cured meats, olive oil, etc. (hereinafter, the “Products”).
- 5.2 Conditions of sale
The sale of THC Ltd. products and services will be governed by the following conditions of sale, as well as these T&C. Please read these conditions carefully before placing an order with THC Ltd., as any order implies acceptance of these conditions.
(i) Our contract:
An order is an offer to THC Ltd. to purchase the products and/or services indicated in the order. After receiving an order for the purchase of a product/service, we will send an email confirmation once the payment has been made.
(ii) Right of cancellation and return policy:
Right of cancellation: Users will have a period of fourteen (14) working days to cancel the contract without incurring a penalty and without the need to indicate a reason.
The term to exercise this right will begin: (a) in the case of products, the day the consumer receives them, and (b) in the case of services, the day the contract is closed.
Return Policy: Customer satisfaction with products is very important to us. That is why we ask our customers to notify us immediately of any damage, delivery error, quality problem or other issues by calling our Sales and Customer Service Department ((0034) 911 441 290 in Spain and (0044) 845 60 38 565 for other countries) or by sending an email to contactus@the-haciendas.com.
(iii) Prices and availability:
All prices indicated include the legal rate of VAT (VAT).
When we process an order, we will inform the User as soon as possible (via email) if any products are not available and we will not charge for said products.
All products and services are subject to availability and vintage changes.
The following shipping costs will apply to purchases made at The Warehouse:
United Kingdom: Free shipping on all orders over £90 to the United Kingdom (excluding the Channel Islands, Isle of Man, Isles of Scilly, Scottish Highlands and Islands, Northern Ireland and the Republic of Ireland). Orders under £90 will be charged at £8.99 per case of 12 bottles per delivery point.
For deliveries to the Isle of Man, Isles of Scilly, Scottish Highlands and Islands or Northern Ireland, please contact our Customer Service Department for a quote.
Due to customs restrictions we are unable to ship to the Channel Islands (Alderny, Gurnsey, Jersey, Sark) and the Republic of Ireland.
Free shipping from €50
Spain and Portugal: €6.95 for orders less than €50.
Other countries: Request a quote by sending an email to contactus@the-haciendas.com.
Shipping costs may vary without prior notice. Shipping is free for some special promotions.
(iv) Payment:
Payment can be made by debit/credit card (Visa, MasterCard or American Express).
When processing or transmitting a credit card CVV number, The Haciendas Company will follow the current PCI Security Standards Council guidelines for information security.
Accommodation reservations at Hacienda Zorita are managed by our partner company Small Luxury Hotels of the World™, so payment is made directly to that company and is not under the control of The Haciendas-Company.
(v) Customs:
Orders placed on the Websites for delivery outside the EU may be subject to taxes and duties which will be collected once the shipment reaches the specified destination. The necessary expenses for customs formalities will be the exclusive responsibility of the User. Customs policies can vary greatly from country to country, so we recommend checking with your local customs authorities for more information. Although we place great importance on the privacy of our Users, international customers should be aware that their shipments may be opened and inspected by customs authorities.
(vi) Our responsibility:
THC Ltd. will not be liable for (i) losses that are not due to any breach by us, or (ii) any business damages (including loss of profits, revenue, contracts, anticipated savings, data, goodwill or valuation of losses), or (iii) indirect or consequential losses that were impossible to foresee at the time of closing the contract or the sale of products. Some of these limitations are not allowed by the laws of some countries. In such event, such limitations will not apply and the customer may have additional rights.
We will not be liable for any delay or failure to perform our obligations under these terms where such delay or failure is due to causes beyond our control.
This condition will not affect the customer's right to receive the products within a reasonable period of time. In the event that the delay occurs before the shipment of the products, we will not make any payment until shipment and the customer can cancel the order at any time before shipment.
6.- Data protection
Responsible and in charge of treatment:
The Haciendas-Company Ltd. – Sucursal em Portugal, with registered office at Avenida de la República nº 15 4º piso, 1050-185 Lisboa is the entity in charge of managing and processing personal data on behalf of The Haciendas-Company Ltd., registered in company registration number 8228267 and with registered office at Broken Wharf House, 2 Broken Wharf, EC4V 3DT London (United Kingdom), which will be considered the Data Controller for the purposes of applicable information privacy regulations.
Both companies are committed to respecting the privacy of individuals and protecting their personal data against any form of misuse.
Data provided by the User:
When a User visits our Websites, registers or purchases our products and services, they may be required to provide certain information (name, contact information and credit or debit card information). We may also obtain information about the use of our Websites and Users from emails or letters sent to us (hereinafter referred to as “Personal Data”). Finally, there is the possibility that we record and monitor the calls received in order to maintain the quality of customer service and facilitate the training of our staff.
Users must notify us of any change in their personal information so that we can keep it updated and error-free at all times.
Use of User information:
THC Ltd. will use the personal data for the following purposes: provision and billing of the products and services requested by the client; customer administration; Dispute resolution; disclosure or promotion of our products and services; creation of profiles of Users for marketing campaigns based on the use of our products, services and Websites by customers; service quality control; Market studies. The use and analysis of the information will also allow us to manage, improve and develop our activities.
By providing us with your telephone number and email address, the User expressly authorizes us to carry out commercial communications by any means, including electronic means, such as SMS, mms, emails or sending messages through computer applications and/or social media. In particular, we may use Personal Data of Users to inform them about our products and services in the tourism, hospitality, gastronomy and other related sectors in accordance with current laws and regulations. In the event that a User no longer wishes to receive this type of information, they can notify our customer service by sending an email to contactus@the-haciendas.com.
Disclosure of User Information:
In order to guarantee the provision of services and the normal operation of the Websites, THC Ltd. may allow access to Personal Data of Users or share such information with its employees, representatives and group companies based in European countries. that offer a similar level of protection:
(i) United Kingdom: United Wineries Ltd. and Zorita's Kitchen Bacchanalia TWS Ltd., both with registered offices at 2, Broken Wharf House, EC4V 3DT (London); (ii) Switzerland: United Wineries International, SA, with registered office at 33 Rue des Bains, 1205 Geneva; (iii) Spain: Corporación Financiera Arco, SL, The Haciendas Warehouse, SL, The Haciendas Company Spain, SL and United Wineries Iberia España SAU, all with registered office at María de Molina 25, 28006 (Madrid), and United Wineries Estates SAU , with registered office at Carretera de Salamanca-Ledesma km. 12, Valverdon (Salamanca); (iv) Norway: United Wineries AS and The Haciendas Company AS, with registered office at Strandgata 41 (Stavanger); (v) Portugal: The Haciendas-Company Ltd. – Sucursal em Portugal, with registered office at Avenida de la República nº 15 4º piso, 1050-185 (Lisbon).
Users explicitly authorize the transfer of their Personal Data to the aforementioned companies and for the purposes contemplated in the section “Use of User Information”.
To the extent required or permitted by law, we may also disclose User information to public entities and agencies, regulatory authorities, or others pursuant to applicable regulations, orders, subpoenas, official requests, or similar processes.
Unless otherwise provided by law, we will not disclose, sell or distribute to public entities and bodies the information provided by Users without their prior authorization.
In order to process orders and other requests, THC Ltd. must provide certain customer data (name, address, telephone number, etc.) to other companies in charge of providing logistics and transport services. In any case, said data will be limited to what is strictly necessary for the processing of the order.
User Rights:
In addition to complying with legal requirements, all Personal Data acquisition and management processes maintain strict levels of security to prevent the loss or manipulation of information.
Rights of Users:
In accordance with applicable law, all customers of THC Ltd. have the right to access their Personal Data and may modify, delete or oppose its use. Security of the User's Personal Data:
We take all reasonable technical and organizational precautions to prevent the loss, misuse or alteration of Users' Personal Data.
All personal information we receive is kept on secure servers (protected by password and firewall). The User accepts the fact that the transmission of data through the Internet is insecure by nature, therefore THC Ltd. cannot guarantee the security of the data sent over the Internet.
Use of “cookies”:
In addition to those cookies strictly necessary for web browsing, such as session cookies, this website uses analytical and advertising cookies, its own and those of third parties (Google Analytics services), which allow information to be stored in the user's browser, which can be retrieved on subsequent visits.
Google Analitycs services are used to measure and analyze web visits. The data obtained will be processed by Google in accordance with the Google Analytics Privacy Policy. Therefore, the exercise of any right related to Google cookies must be done by communicating directly to those responsible for this website.
By browsing our website we consider that the USER accepts the use of cookies and IP address tracking files whose use allows THC Ltd. to collect data for statistical purposes such as: date of the first visit, number of times visited, date of the last visit, URL and domain from which it comes, browser used and screen resolution.
In any case, the USER may prevent the installation of cookies or delete those that have already been installed, through the configuration of their browser, as well as through the use of specific applications. However, THC Ltd. is not responsible for the fact that their deactivation prevents the proper functioning of the page. The information obtained is completely anonymous, and in no case can it be associated with a specific and identified user.

7.- Veracity of the information
Although we have made every effort to ensure the accuracy of the information on the Websites, THC Ltd. is not responsible for any errors. No warranty, express or implied, is made that the information provided on the Websites is error-free. To the maximum extent permitted by law, THC LTD. excludes any type of manifestation, guarantee or condition in relation to the Websites and the use thereof, including, among others, implicit legal guarantees of quality, suitability for a specific purpose and / or adoption of opportune measures.
Information (including text, images, analytics, and offers) may be inaccurate as a result of facility renovations or repairs. The Websites may also contain typographical errors or omissions. THC LTD. will not assume any responsibility for errors, omissions or possible discrepancies between the rooms, facilities or services available and those described on the Websites, for which reason it will not be responsible for any damages that may result from them. The images have no contractual value.
Contents on the web's or promotional newsletters may contain typographical errors or omissions. Vintages and stocks subject to availability.
8.- Customer service

9.- Civil liability
Although we do everything in our power to guarantee the availability of the Websites and the absence of errors in the transmissions, the nature of the Internet prevents us from offering any guarantee in this regard. In addition, access to the Websites may be temporarily suspended or limited to carry out repair work, maintenance or the introduction of new products or services, although we will try to limit the frequency and duration of such suspensions or limitations.
THC and/or THC Ltd. will not be liable for (i) losses that are not due to any breach by us, or (ii) any business losses (including loss of profits, revenue, contracts, anticipated savings, data, fund trading or valuation losses), or (iii) indirect or consequential losses that were impossible to foresee at the beginning of the use of the Websites.
We will not be liable for any delay or failure to perform our obligations under these terms where such delay or failure is due to causes beyond our control. This condition will not affect the customer's right to receive the products within a reasonable period of time or to be reimbursed in the event of not receiving the products or services within a reasonable period of time due to causes beyond our control.
Some of these limitations are not allowed by the laws of some countries. In such event, such limitations will not apply and the customer may have additional rights.
Nothing in these terms limits or excludes our liability for fraudulent representations or for death or personal injury that is attributable to negligence or deliberate failure on our part.
10.- Intellectual property rights
All trademarks, logos, designs, service marks, text, graphics, images, and data compilations displayed or accessible on the Websites (collectively, the "Trademarks") are registered and/or legally recognized trademarks of The Haciendas. -Company Ltd. Reproduction or use of Trademarks is prohibited without the prior written permission of The Haciendas Company Ltd. Nothing contained on the Websites may be construed as an implied grant, estoppel or otherwise, of a license or right to use the Trademarks without the prior written permission of The Haciendas Company Ltd. or any other owner of the Trademarks.

Links to Other Websites: All links to other websites from the Websites are provided in good faith and for the sole purpose of providing yet another choice for visitors to the Websites. These links are governed by the following conditions:
THC Ltd. assumes no responsibility for the content (including privacy policies) of other websites or for any links contained therein.
No link to other websites controlled by third parties may be construed as a commercial endorsement or recommendation by THC Ltd.
THC Ltd. has no control over the content of other websites and will not accept any responsibility for them or for any loss or damage that may arise from their use.
Links to the Websites: THC Ltd. welcomes the inclusion of links to the Websites, provided that such links meet the following conditions:
Links to the Websites must not be misleading.
In all cases, an appropriate text will be used to describe the link.
Use of the THC Ltd. logo or any other THC Ltd. Trademarks in links to the Websites (or for any other purpose) without our prior written permission is prohibited.
The use of frames or similar technology to display the content of the Websites is prohibited.
At the request of THC Ltd., the link to the Websites must be removed as soon as possible.
Link removal: If you would like to request a link to be removed, please send an email to contactus@the-haciendas.com. However, such removal will be at our sole discretion, unless there is a legal obligation.
12.- Jurisdiction and applicable law
These Terms and Conditions and all matters relating to them shall be governed by and construed in accordance with the laws of England and Wales. Any litigious issue that concerns these Terms and Conditions will be resolved through the consumer arbitration courts, mediators or similar to which THC Ltd. is adhered at the time of the dispute, as well as the corresponding courts and tribunals in accordance with the laws of England and Wales.
